Terms of Service

These Terms of Service ("Terms") govern your access to and use of CostForge and its related services (collectively, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By registering for an account, you confirm that you are at least 18 years old, have the authority to bind the business or organisation on whose behalf you are registering, and agree to these Terms and our Privacy Policy.
2. The Service
CostForge provides a cloud-based platform for job costing and quoting aimed at trade businesses. Features include client management, job tracking, quote generation, team collaboration, and PDF export.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable to you or any third party for any such changes.
3. Accounts and Security
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us immediately at info@costforge.co.uk if you suspect any unauthorised access to your account.
- Each account (tenant) is separate. You may not share accounts across organisations without our prior written consent.
- You must provide accurate and complete information when creating an account and keep it up to date.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Upload or transmit malware, viruses, or any malicious code
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Scrape, crawl, or harvest data from the Service by automated means without our express written permission
- Use the Service to spam, phish, or send unsolicited communications
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.
5. Your Data
You retain full ownership of all data, content, and information you submit to the Service ("Your Data"). By using the Service, you grant CostForge a limited, non-exclusive, royalty-free licence to store, process, and display Your Data solely to provide and improve the Service.
You are responsible for the accuracy and legality of Your Data. We do not review or verify the business records you enter.
On account closure, you may request an export of Your Data within 30 days of cancellation. After that period we may delete Your Data from our systems.
6. Subscription and Payments
The Service is currently offered under a Free tier. When paid plans are introduced, the following terms will apply:
- Subscription fees are billed in advance on a monthly or annual basis as selected at sign-up.
- All fees are exclusive of applicable taxes, which you are responsible for.
- Paid subscriptions auto-renew unless cancelled before the renewal date via your account settings.
- Refunds are offered at our discretion. We do not provide pro-rated refunds for partial periods except where required by law.
- Failure to pay may result in suspension or termination of your account after a grace period.
7. Intellectual Property
The Service and all underlying technology, trademarks, logos, and content produced by CostForge are our exclusive property or the property of our licensors. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited licence to use it in accordance with these Terms.
Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation to you.
8. Third-Party Services
The Service may integrate with or link to third-party services (e.g. payment processors, email providers). These third parties have their own terms and privacy policies, and we are not responsible for their practices. Your use of any third-party service is at your own risk.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, CostForge and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim or (b) £100 GBP.
11. Indemnification
You agree to indemnify and hold harmless CostForge and its affiliates, officers, agents, and employees from any claim, demand, loss, or damage — including reasonable legal fees — arising out of your use of the Service, Your Data, or your violation of these Terms.
12. Termination
Either party may terminate the agreement at any time. You may close your account via account settings. We may suspend or terminate your access for breach of these Terms, non-payment, or any reason we reasonably consider harmful to the Service or other users, with or without notice.
On termination, all licences granted to you immediately cease. Clauses 5 (Your Data export rights), 7 (IP), 9 (Disclaimers), 10 (Limitation of Liability), and 11 (Indemnification) survive termination.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and close your account before the effective date.
